Please read all the provisions in these Terms and Conditions carefully before using the KawanBerbagi Platform, because they affect your rights and obligations as a User of the KawanBerbagi Platform this. If the User performs activities such as visiting, registering, and/or using the KawanBerbagi Platform, then the User declares that he has read, understood, comprehended, and agreed to all provisions, including all changes and/or additions to provisions from time to time which are an integral part of these Terms and Conditions. If the User does not agree to one, part, or all of the provisions in these Terms and Conditions and their changes, then the User is not permitted to use the services on this Platform.

Important

The Privacy Policy referred to on this page is a reference to regulate and a form of real commitment from the KawanBerbagi Platform to protect the use of Personal Data and Metadata belonging to Users. Every term and definition explained in the Terms and Conditions also applies to this Privacy Policy. KawanBerbagi has the right to modify, add, and/or change the Policy at any time by providing notification to Users through KawanBerbagi's communication media. The new rules will come into effect after the notification has been published or sent to all Users of the KawanBerbagi Platform. The agreement may not apply if there are changes due to Indonesian legal reasons and the KawanBerbagi Platform policy will change in accordance with applicable laws and regulations.

A. Consent

If the User accesses, registers, and/or uses services on the KawanBerbagi Platform, then the User declares that all data provided is correct and valid. You as a User acknowledge that you have received and understood the provisions of this Privacy Policy and give your consent to KawanBerbagi to collect, store, obtain, use, process, control, transfer, send, disclose, and protect your data to facilitate various service processes within the KawanBerbagi Platform and other purposes as long as permitted by applicable laws and regulations.

B. Acquisition and Collection of Data

1. KawanBerbagi collects and uses User Data so that the KawanBerbagi Platform can be used according to its intent and purpose, to support performance efficiency, and to improve the quality of the KawanBerbagi Platform's services.
2. The data that the KawanBerbagi Platform collects includes Personal Data, Metadata, and other information that Users provide directly or that is collected automatically due to the use of the KawanBerbagi Platform. Data submitted by the User independently, including but not limited to submission to the process:
   • Creation and/or updating of KawanBerbagi accounts, including full name (username), email address (email), mobile phone number, password and other information that can identify the User;
   • Completing surveys sent by KawanBerbagi;
   • Filling in the data required when carrying out Donation activities, such as full name, email address, mobile phone number, and/or other additional information requested if the Donor uses a payment method with bank transfer services, virtual accounts ("VA"), debit/credit cards, and electronic wallets registered with Bank Indonesia and in collaboration with KawanBerbagi;
   • Filling in the data required when creating a Fundraising (Donation), such as full name, email address, mobile phone number, social media address, and/or other information according to the needs of the KawanBerbagi Platform;
   • Verification and/or disbursement, such as identity documents, medical documents, Family Card ("KK"), proof of payment documents or other information in other forms and ways that the KawanBerbagi Platform requests from time to time;
   • Collection of documents required during special cooperation, including but not limited to written agreements and made separately with this Privacy Policy; and/or
   • Data collected automatically when Users use the KawanBerbagi Platform such as, internet protocol address, geographic location (geolocation), operating system and browser version of the device you use to access the KawanBerbagi Platform, data traffic, site recordings, and other communication data.
   • Other data usage used for internal KawanBerbagi purposes.
3. KawanBerbagi can collect Cookies contained in the User's device browser while the KawanBerbagi Platform is used to recognize and remember certain information including session management, service personalization, and recording User activity on the KawanBerbagi Platform. Users can disable Cookies on the site, but this may limit the optimization of services when you access the site.

C. Use of Data

1. KawanBerbagi can use Data for the following purposes, or for other purposes permitted by applicable laws and regulations, including:
   • Identifying and processing requests for use of the KawanBerbagi Platform, including facilitating or conducting any verification that KawanBerbagi considers necessary for the benefit of using the KawanBerbagi Platform and/or implementing the principle of knowing your customer (Know Your Customer);
   • Providing KawanBerbagi Platform services.
   • Providing notifications or information related to the use of accounts, the KawanBerbagi Platform, and/or Platform services KawanBerbagi, including any updates or changes to the KawanBerbagi Platform or KawanBerbagi Platform services;
   • Allowing Users to use the interaction/communication features with KawanBerbagi through the KawanBerbagi Platform, including consumer services to answer questions and/or complaints;
   • Efforts to ensure that the content, content, and all information on the KawanBerbagi Platform is displayed in the most effective manner for Users and the electronic devices that Users use;
   • Monitor and/or analyze the use and management of the KawanBerbagi Platform in order to support the efficiency and effectiveness of the KawanBerbagi Platform and its functions, including the pattern of use of the KawanBerbagi Platform and activities, behavior and demographic data, including habits and use of various services available on the KawanBerbagi Platform;
   • Improve, enhance the quality, and/or develop services on the KawanBerbagi Platform;
   • Provide assistance in connection with efforts to resolve operational and technical problems on the KawanBerbagi Platform;
   • Prevent, detect, and/or investigate any activities that are prohibited, unauthorized, unlawful or constitute any form of fraud;
   • Produce information and data from analysis for testing, research, analysis, product development, commercial partnerships, and cooperation;
   • Enable KawanBerbagi to comply with all obligations under regulations applicable laws; and
   • Contacting Users through communication media that have been provided by Users to KawanBerbagi in relation to the use of the KawanBerbagi Platform services.
2. Use and storage of Data will be carried out by KawanBerbagi in accordance with applicable laws.
3. Data, including User Personal Data, will only be stored as long as necessary to fulfill the purpose of its collection, or as long as such storage is required or permitted by applicable laws and regulations. KawanBerbagi will stop storing Personal Data as soon as it is deemed that the purpose of collecting and storing such Personal Data is no longer required for the purposes of the KawanBerbagi Platform service or by law.
4. The User acknowledges and agrees that there is a possibility that data, including the User's Personal Data, is reasonably obtained and stored by KawanBerbagi, and hereby agrees to release KawanBerbagi (and all officers, directors, commissioners, employees, agents, affiliates, partners, suppliers, and contractors) from and against all claims, losses, obligations, costs, damages, and expenses (including but not limited to legal costs and full compensation expenses) arising as a result of the Circumstances and/or technological failures in the form of unauthorized or unlawful use, storage and/or disclosure of data, including the User's Personal Data.

D. Provision or Disclosure of Data

1. The User agrees to the provision or disclosure of data, including the User's Personal Data, by KawanBerbagi to third parties that are reasonably necessary to improve the performance and quality of the KawanBerbagi Platform, develop the features of the KawanBerbagi Platform, services, and products that KawanBerbagi offers, including, among others, to carry out maintenance and management of the KawanBerbagi system, devices, and network, to consultants, auditors, service providers, and/or professional advisors.
2. KawanBerbagi may provide or disclose data, including the User's Personal Data, if required by a court ruling or decision, order, or decision from an authorized institution, to comply with applicable laws and regulations, or in the event of a legal process, taking further preventive measures in connection with unauthorized or unauthorized activities, or suspected criminal acts or violations of the law.
3. KawanBerbagi will make reasonable efforts to delete irrelevant Personal Data before providing or disclosing data, including the User's Personal Data.
4. KawanBerbagi may remove certain parts of the User's Personal Data that can identify the User, so that it becomes anonymous data, and disclose the anonymous data to third parties. KawanBerbagi may also combine the User's Personal Data with other information in such a way that the information is no longer associated with the User, then disclose the combined information to third parties.
5. KawanBerbagi does not sell, distribute, or rent the User's Personal Data to any third party.
6. If the User consciously fills in the check box "I am willing to be contacted..." when carrying out Donation activities in certain Fundraising (Donations), then the User agrees and authorizes KawanBerbagi to provide or disclose data, including the User's Personal Data, namely the name and email address registered on the KawanBerbagi Platform, to third parties approved by the User and working with KawanBerbagi for the operation of the KawanBerbagi Platform.

E. Security

Confidentiality of the User's Personal Data is very important to KawanBerbagi. The KawanBerbagi Platform endeavors and takes reasonable steps to protect data security, including User Personal Data, including through the use of technology to scramble communication paths between computers so that they cannot be read by other parties. However, KawanBerbagi cannot fully guarantee that the KawanBerbagi system is completely impenetrable by viruses, malware, interference, hacking, violations of the law or unauthorized access by third parties.

F. Rights of Access and Request for Changes to Personal Data

Users have the right to access User Personal Data stored on the KawanBerbagi Platform by submitting an access request via Kawanberbagi.org. Users also have the right to change the Personal Data stored, such as email address, mobile phone number, password by submitting the notification and other information required by the KawanBerbagi Platform via Kawanberbagi.org.

G. Request for Deactivation and/or Deletion of Accounts and Personal Data

1. Users have the right to request deactivation and/or deletion of accounts and User Personal Data stored on the KawanBerbagi Platform by agreeing to and complying with the terms and procedures determined by applicable laws and regulations, by submitting a request and providing the information required by the KawanBerbagi Platform via Kawanberbagi.org and/or the account deactivation and/or deletion feature, with the following conditions:
   • Send an email using the email registered with KawanBerbagi;
   • Photo of the latest identity card;
   • Photo of yourself holding an identity card.
2. Users understand and agree that deactivation and/or deletion of User Accounts and Personal Data, either in part or in whole, may result in the User no longer being able to use the KawanBerbagi Platform.
3. KawanBerbagi will evaluate the request for deactivation and/or deletion of the User's account and Personal Data. If the terms and conditions for deactivation and/or deletion of the account and Personal Data are not met, then KawanBerbagi will confirm to the User, where the User is willing to be contacted. Terms and conditions related to deactivation and/or deletion of the account and Personal Data can be seen on the How to Deactivate an Account and Personal Data page on KawanBerbagi.

H. Changes

Based on Kitabisa's own discretion, KawanBerbagi has the right to change the Privacy Policy at any time by notifying the User. The User can access any changes to this Privacy Policy on the KawanBerbagi Platform. When accessing and/or using the KawanBerbagi Platform, the User acknowledges that they have received, understood, and given their consent to the changes to the provisions of the Privacy Policy. If the User does not agree to any, part, or all of the changes to the Privacy Policy, then the User is not permitted to use the services on this KawanBerbagi Platform.

I. Applicable Law and Disputes

This Privacy Policy and its implementation are governed by and subject to Indonesian law.
The Parties agree to resolve any disputes in connection with this Privacy Policy through mutual agreement. If the dispute cannot be resolved through mutual agreement within 30 (thirty) calendar days from the receipt of written notification by one Party given by the other Party regarding the emergence of the dispute, then the dispute in question will be resolved through the Indonesian National Arbitration Board domiciled at Wahana Graha, 1st & 2nd Floor, Jl. Mampang Prapatan No. 2, Jakarta 12760 ("BANI").

J. Contact

Users can submit suggestions, requests, complaints or questions related to the KawanBerbagi Platform to KawanBerbagi via Kawanberbagi.org. KawanBerbagi will verify the User's information or data before responding to or responding to the User's suggestions, requests, complaints, and/or questions. KawanBerbagi has the right to refuse to process or respond to the User's suggestions, requests, complaints, and/or questions when the information or data provided by the User does not match the information or data listed on the KawanBerbagi Platform system.
The verification process until providing a response to the User's suggestions, requests, complaints, and/or questions is carried out in accordance with the Privacy Policy and KawanBerbagi's internal policies and procedures that apply from time to time.
